Your Seller Funds and associated benefits, including but not limited to Premium Payouts incentives and spending bonus incentive, are personal to you and may not be sold, transferred, assigned, or shared with, in whole or in part, with family, friends or any other persons, or used by you, your agents, employees, directors, officers, or assignees, for any commercial purpose. You may have only one (1) Eluse account that is personal to you.
Fraudulent Use
Without notice to you, Eluse reserves the right to suspend any Seller Funds registered to your account and/or terminate your account and/or your participation in incentives if Eluse determines, in its sole discretion, that you have violated these Terms & Use or that the use of your Eluse account is unauthorized, deceptive, fraudulent or otherwise unlawful.Eluse may, in its sole discretion, suspend, cancel or combine Eluse accounts that appear to be duplicative. In the event that your Eluse account is terminated, all accrued seller funds, site credit and rewards in your account are void.
Our Liability
If we have acted with reasonable precautions and/or in accordance with our legal obligations, we are not liable for any unauthorized, incorrectly, unexecuted, or delayed payment transactions when such issues were caused by abnormal and unforeseeable circumstances beyond our control.
Cash-Out Fee
Eluse reserves the right to charge a withdrawal fee on funds withdrawn to your designated payout account, including but not limited to Hong Kong local bank accounts, international bank accounts, and PayPal. This fee may apply to withdrawals that meet specific criteria, such as, but not limited to, funds that have been held in your account for a short duration (e.g., less than 30 days).Where applicable, the fee will be calculated as a percentage of the transaction amount (e.g., 3%) and will be deducted from the total amount of your withdrawal request. The net amount you receive will be the requested withdrawal amount minus the applicable fee. The specific conditions and percentage of such fees may be adjusted by Eluse from time to time and will be announced in advance on the platform.
Receipt and Settlement of Funds
Upon completion of a withdrawal transaction, you will receive a notification confirming the payment. As Hong Kong is a tax-free port, Eluse will not collect or remit sales taxes on your behalf; however, you are responsible for complying with all applicable tax regulations in the jurisdiction where you receive funds or where the goods are delivered.
In certain cases, your transaction may be declined, frozen, or delayed for various reasons, including, but not limited to, suspected fraud, high-risk transactions, violations of applicable laws or regulations, international trade restrictions, Eluse platform policies, or the policies of third-party payment service providers.
If settlement of funds cannot be completed for compliance or operational reasons, depending on the circumstances, we may:
   •    Return your consigned item;
   •    Make payment via an alternative settlement method;
   •    Handle the funds in accordance with applicable laws, including treating them as unclaimed property and remitting them to the relevant Hong Kong government authority after the statutory period;
   •    Or take other action in accordance with our policies.
If there is a dispute between you and Eluse, Eluse reserves the right to withhold payment of any amounts due to you until the dispute is resolved, including, without limitation, amounts unrelated to the dispute. Eluse may withhold part or all of your payout (including amounts for sold items that are not related to the dispute) to offset any amounts you owe to Eluse
Limitation of Liability
To the fullest extent permitted by law, Eluse will not be liable for any damages of any kind arising out of or in connection with your participation or membership in the program, including damages arising out of changes to or termination of the program. This is a comprehensive limitation of liability that applies to all damages of any kind, including but not limited to direct, indirect, incidental, punitive or consequential damages, loss of data, income or profit, loss of, or damage to property and claims of third parties.
Eluse+ TERMS AND CONDITIONS
These Program Terms and Conditions apply to the Eluse+ Membership program.
By selecting the membership during checkout, you will be enrolled in a flexible, active membership with many benefits. The Eluse+ benefits can change from time to time and can include at Eluse’s discretion special discounts on purchases, in addition to exclusive deals and sales, bonuses, reward points and free domestic shipping and exchanges in the U.S. Benefits of joining the Eluse+ membership are detailed during checkout and can be found in our Frequently Asked Questions and can be edited by Eluse at any time.
SHIPPING PROTECTION SERVICE
Items purchased from Eluse 
Shipping Protection Service. The Company offers shipping protection for select products purchased by the end-user. For the avoidance of doubt, you expressly acknowledge and agree that (a) the value coverage provided by the services (including any shipping protection) is not and shall not constitute insurance of any kind whatsoever; (b) in the event of any loss or damages of the products purchased by the customer, upon final determination by the company that the product(s) or item(s) purchased by you was, in fact, damaged or lost, with such determination being made in the sole and absolute discretion of the company, you will be provided up to a maximum of $3,000.00 of the declared value (defined below) of the total value of all the products or items purchased by you and shipped by The Company and that are deemed damaged or lost and for which Shipping Protection has been Purchased; and (c) the shipping protection services contemplated herein shall only be provided to eligible customers who have purchased the service.
Declared Value. “Declared Value” shall mean the cost of the product, merchandise or item as stated by the Company when purchased by you.
Procedure for Shipping Protection.
Timely Notice. You must notify the Company of any lost or damaged products, for which shipping protection has been purchased, within 15 days of the date that such product(s) were purchased from the Company. You acknowledge and agree that if you fail to provide timely notice as provided above, you will not be provided any benefits of the shipping protection service and will not receive any refund of your purchase of the same. Upon receiving such notice, the Company will respond as soon as reasonably practicable.
Additional Verification. You will be required to provide evidence that such products or items that were lost, stolen or damaged, and, for the avoidance of doubt, the determination of whether an item has been lost, stolen or damaged will be made by the Company, in its sole and absolute discretion. You agree to provide any additional information or documentation as may be reasonably requested by the Company. For the avoidance of doubt, any item for which the carrier confirms delivery as per the tracking can never be deemed lost and therefore Shipping protection service cannot be exercisable in such case.
Ownership After Shipping Protection Has Been Utilized. You expressly acknowledge and agree that for any lost, stolen or damaged products or items for which the Company has approved for the Company’s shipping protection service (whether a product or item has been replaced or for which you received a refund), such lost, stolen or damaged products or items will be deemed the property of the Company. Accordingly, you expressly agree to ship to the Company any (A) damaged products or items, or (B) any previously lost or stolen products or items, if you come into possession of such lost or stolen products or items. You further acknowledge and agree that the Company shall have full authority to take any actions it deems appropriate to track any lost or stolen products or items and in the event the Company comes into possession of such products or items, the Company will be deemed the sole and exclusive owner of such products or items.
Items sold to Eluse 
The Company offers shipping protection for select products sold and shipped by you. For the avoidance of doubt, you expressly acknowledge and agree that (a) the value coverage provided by the services (including any shipping protection) is not and shall not constitute insurance of any kind whatsoever; (b) in the event of any loss or damages of the products sold and shipped by you, upon final determination by the Company that the product(s) or item(s) sold by the you was, in fact, damaged or lost, with such determination being made in the sole and absolute discretion of the Company, you will be provided up to $3,000.00 of the quoted value of all of the products or items sold and shipped by you to The Company and for which you had purchased the Shipping Protection; and (c) the shipping protection services contemplated herein shall only be provided to eligible customers who have purchased the service. For the avoidance of doubt the $3,000 cap shall apply once per order. In the case of multiple items that total an amount greater than $3,000 the cap shall remain at $3,000 regardless of the number of items.
Declared Value. “Declared Value” shall mean the cost of the product, merchandise or item as quoted or estimated by the Company.
Procedure for Shipping Protection
Timely Notice. You must notify the Company of any lost or damaged products, for which shipping protection has been purchased, within 15 days of the date that such product(s) were sold and shipped by you. You acknowledge and agree that if you fail to provide timely notice as provided above, you will not be provided any benefits of the shipping protection service and will not receive any refund of your purchase of the same. Upon receiving such notice, the Company will respond as soon as reasonably practicable.
Additional Verification. You will be required to provide evidence that subject products or items that were lost, stolen or damaged, and, for the avoidance of doubt, the determination of whether an item has been lost, stolen or damaged will be made by the Company, in its sole and absolute discretion. You agree to provide any additional information or documentation as may be reasonably requested by the Company. In particular you will be required to provide a video of the package being closed and handed to the carrier. The video must clearly show all the items being placed in the box and handed to the carrier and then closed. The video must be time stamped and be a genuine video. In the absence of such proof the shipping protection will be void and no reimbursement shall be due.
Exclusions. The company will have the right to accept or decline the reimbursement at each sole discretion. In particular any possible fraudulent activity from the seller shall make the shipping protection void. Shipping protection is only valid if the seller used the shipping label provided by the Company and as long as the seller has delivered the packaged items to the Company's contracted carrier.
Ownership After Shipping Protection Has Been Utilized. You expressly acknowledge and agree that for any lost, stolen or damaged products or items for which the Company has approved for the Company’s shipping protection service (whether a product or item has been replaced or for which you received a refund), such lost, stolen or damaged products or items will be deemed the property of the Company. Accordingly, you expressly agree to ship to the Company any (A) damaged products or items, or (B) any previously lost or stolen products or items, if you come into possession of such lost or stolen products or items. You further acknowledge and agree that the Company shall have full authority to take any actions it deems appropriate to track any lost or stolen products or items and in the event the Company comes into possession of such products or items, the Company will be deemed the sole and exclusive owner of such products or items.
DOMESTIC SUPPLY
Eluse may purchase eligible items from sellers located worldwide, subject to the platform’s requirements.
   •    You must confirm that your items have been lawfully acquired in the country of origin or export, and that all applicable customs clearance procedures and duties/taxes (if any) have been properly completed before the items are shipped to Hong Kong.
   •    You may either deliver items to any designated Eluse drop-off location or ship them to Eluse’s Hong Kong receiving center using the prepaid shipping label provided by Eluse.
   •    Any shipment received by Eluse using a shipping label not provided by Eluse will be rejected and returned to the sender at the sender’s own expense.
   •    All payments for products will be made to the payout account linked to your Eluse account, which may include Hong Kong local bank accounts, international bank accounts (via SWIFT), or PayPal.
Eluse Anti-Money Laundering (AML) Policy
1. Introduction
Eluse is a luxury resale company headquartered in Hong Kong, specializing in secondhand handbags, watches, jewelry, and accessories. As a high-value goods platform, Eluse is committed to preventing money laundering, terrorist financing, and other illicit activity on its website, app, and retail locations. This policy outlines specific procedures tailored to Eluse’s business model, inventory categories, and operational risk.
2.Regulatory Framework
Eluse complies with applicable laws and regulations in Hong Kong, including the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (AMLO, Cap. 615) and guidelines issued by the Customs and Excise Department of Hong Kong. Eluse also observes obligations arising from its payment processing providers, including Shopify Payments, Stripe, PayPal, and Hong Kong licensed banks.
3.Risk-Based Approach
Eluse adopts a layered, risk-based approach to AML oversight. Transactions involving items containing precious metals/stones over HKD 80,000 are subject to enhanced scrutiny. Eluse’s fraud and compliance teams routinely assess buyer and seller behavior using internal tools and external signals.
4. Customer Due Diligence (CDD)
For transactions involving items with precious metals and/or over HKD 80,000, customers must complete enhanced CDD procedures, including identity verification, source of funds, and transaction purpose review, in accordance with Hong Kong AML regulations.
5. Recordkeeping
Eluse may store the following records in encrypted systems:
User ID documents and verification outcomes
All purchase and sales history, including canceled or returned orders
Internal risk or fraud reviews
6. Monitoring & Reporting
•    Eluse’s Review Team may escalate high-risk cases to the Anti-Money Laundering (AML) Officer.
   •    When necessary, Eluse will file a Suspicious Transaction Report (STR) through legal counsel, in alignment with the Hong Kong Anti-Money Laundering and Counter-Terrorist Financing Ordinance (AMLO) and other applicable regulatory requirements.
Sanctioned Countries Policy
1. Overview
Eluse does not engage in business—directly or indirectly—with individuals or shipping addresses connected to sanctioned jurisdictions. Eluse actively blocks transactions based on OFAC and Shopify/Stripe restrictions.
2. Prohibited Jurisdictions
Eluse automatically restricts purchases and sales from:
Cuba
Iran
North Korea
Syria
Crimea, Donetsk, and Luhansk regions of Ukraine
Russia (with respect to entities, individuals, and certain luxury goods under embargo)
3. Watchlist and High-Risk Country Screening
Eluse also does not ship to certain countries including:
Afghanistan, Belarus, Central African Republic, DRC, Lebanon, Libya, Myanmar, Nicaragua, Somalia, South Sudan, Sudan, Venezuela, Yemen, Zimbabwe

Customer Onboarding & KYC Procedures
1. Purpose
Eluse ensures that all individuals comply with internal onboarding and KYC requirements based on transaction value and geography.
2. Identity Verification
All clients must create an account with a verified email address and phone number.
.    All purchases with transactions above HKD 80,000 in aggregate are subject to mandatory KYC (Know Your Customer) checks in accordance with the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (AMLO) of Hong Kong, including submission of a valid government-issued identification document.
.    Identity verification and fraud scoring are conducted using secure third-party tools.
   .    High-risk transactions will be reviewed by the Eluse fraud prevention team before order fulfillment.
3. Transaction Monitoring
High-risk transactions are reviewed by the Eluse fraud team, before fulfillment.
4. Documentation Retention
All documents and verification logs are securely stored within Eluse's system.
